1. Agreement to Terms
1.1. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and aXai Pty Ltd ("aXai", "we", "us", "our") governing your access to and use of the DisabilityX platform, including any associated websites, applications, services, and technologies (collectively, the "Platform").
1.2. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
1.3. We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform following any changes constitutes acceptance of the modified Terms.
1.4. These Terms are governed by the laws of Victoria, Australia.
2. About DisabilityX
DisabilityX is a disability-led media platform featuring:
- Axel's Podcast - stories from the institutionalised, homeless, and silenced
- Journal of Neurotypical Studies - satire and systems analysis
- Community stories and resources
- NDIS provider directory and accessibility tools
Our mission is to centre people with disability as the authority on their own experiences.
3. Definitions
3.1. "Content" means any text, images, audio, video, data, software, or other materials uploaded, submitted, or displayed on the Platform.
3.2. "Intellectual Property" means all patents, trademarks, service marks, trade names, domain names, copyrights, moral rights, design rights, database rights, trade secrets, know-how, inventions, processes, techniques, and all other intellectual property rights, whether registered or unregistered.
3.3. "Platform Technology" means all software, algorithms, code, architectures, interfaces, APIs, designs, methodologies, processes, and technologies that comprise or enable the Platform.
3.4. "User Content" means any Content that users submit, upload, or transmit through the Platform, including stories, articles, and podcast contributions.
3.5. "Platform Content" means all Content provided by aXai through the Platform, including but not limited to Platform Technology, documentation, designs, articles, resources, and generated outputs.
3.6. "AI-Generated Content" means any Content created, modified, or enhanced by artificial intelligence systems within the Platform, including but not limited to text simplification, accessibility features, AI avatars, and AI assistant responses.
4. Content Submissions
Your Rights
- You retain ownership of your stories and content
- You may withdraw consent for publication at any time
- You control how you are identified (named, pseudonymous, or anonymous)
- You may request edits or removal of published content
License Grant
By submitting content, you grant DisabilityX a non-exclusive, royalty-free license to publish, distribute, and promote your content across our platforms. This license is revocable—you may withdraw it at any time by contacting us.
Your Responsibilities
- Content you submit must be your own or you must have rights to share it
- Content must not defame named individuals without factual basis
- Content must not incite violence or hatred
- You are responsible for ensuring your content does not breach confidentiality obligations you may have
5. Editorial Rights
DisabilityX reserves the right to:
- Accept or decline submissions at our discretion
- Edit content for clarity, length, or legal reasons (with your approval for significant changes)
- Remove identifying details to protect anonymity when requested
- Decline to publish content that could expose us or you to legal liability
We will not change the meaning or substance of your story without your consent.
6. Podcast Appearances
If you appear on Axel's Podcast:
- You may use an AI-generated avatar to protect your identity
- You may provide written responses instead of speaking live
- You may request structured questions in advance
- You may have a support person present
- You may withdraw consent before publication
- Once published on YouTube, removal may take up to 30 days
7. Intellectual Property Rights
aXai Ownership
7.1. aXai owns and retains all right, title, and interest in and to:
- (a) The Platform and all Platform Technology;
- (b) All Platform Content;
- (c) All trademarks, service marks, logos, and trade names associated with the Platform, including but not limited to "DisabilityX", "aXai™" (registered trade mark), "aXread", "Axel", and associated visual identities;
- (d) All inventions, methodologies, processes, and innovations developed by or for the Platform;
- (e) All AI models, algorithms, training data, and AI-generated outputs created by the Platform;
- (f) All improvements, modifications, and derivative works of the foregoing, regardless of who suggests or contributes to such improvements.
7.2. Nothing in these Terms transfers any Intellectual Property rights to you except as expressly stated.
7.3. All rights not expressly granted herein are reserved by aXai.
Your Content
7.4. You retain all rights to stories, experiences, and ideas you submit. Our license to use your content is non-exclusive—you may publish elsewhere.
AI-Generated Content
7.5. AI-Generated Content created through the Platform is owned by aXai. Users are granted a licence to use AI-Generated Content created during their use of the Platform for personal purposes, subject to:
- (a) Attribution to DisabilityX or aXai where reasonably practicable;
- (b) Not representing AI-Generated Content as solely human-created where disclosure is required by law;
- (c) Not using AI-Generated Content to train competing AI systems.
7.6. AI-generated avatars and voice synthesis used in podcasts are created using third-party tools (HeyGen) and are subject to their terms.
Feedback and Suggestions
7.7. Any feedback, suggestions, ideas, or improvements you provide regarding the Platform ("Feedback") shall become the exclusive property of aXai.
7.8. You hereby assign to aXai all right, title, and interest in any Feedback, including all Intellectual Property rights therein.
8. Disability Sector Information
General Information Only
8.1. Information provided on the Platform about disability services, NDIS, legal rights, and related matters is for general informational purposes only.
8.2. The Platform does not provide:
- (a) Legal advice;
- (b) Medical or healthcare advice;
- (c) Financial advice;
- (d) NDIS plan management services;
- (e) Official government services.
8.3. Users should seek professional advice for specific situations and verify information with official sources.
8.4. The Journal of Neurotypical Studies contains satire. While grounded in real issues, it uses humour and exaggeration for effect.
Provider Directory
8.5. The Platform may include a directory of disability service providers. aXai:
- (a) Does not endorse any particular provider;
- (b) Does not verify provider credentials or quality of service;
- (c) Is not responsible for services provided by listed providers;
- (d) Recommends users conduct their own due diligence.
9. Confidentiality
9.1. "Confidential Information" means any non-public information disclosed by aXai, including but not limited to:
- (a) Platform Technology and source code;
- (b) Business strategies, plans, and processes;
- (c) Pricing information and financial data;
- (d) Customer and user data;
- (e) Any information marked as confidential.
9.2. You agree to:
- (a) Maintain the confidentiality of all Confidential Information;
- (b) Not disclose Confidential Information to any third party without prior written consent;
- (c) Use Confidential Information only as necessary to use the Platform;
- (d) Notify aXai immediately of any unauthorised disclosure.
9.3. These confidentiality obligations survive termination of these Terms.
10. Prohibited Uses
10.1. You agree not to use the Platform to:
- (a) Violate any applicable laws or regulations;
- (b) Infringe any third party's Intellectual Property or other rights;
- (c) Upload malicious code, viruses, or harmful content;
- (d) Harass, abuse, or harm other users, particularly those with disabilities;
- (e) Spread misinformation or deceptive content about disability services or rights;
- (f) Engage in fraudulent activities, including misrepresenting NDIS services;
- (g) Circumvent security measures or access restrictions;
- (h) Interfere with the proper functioning of the Platform;
- (i) Collect user data without consent;
- (j) Use the Platform in any manner that could damage aXai's or DisabilityX's reputation;
- (k) Discriminate against or exploit people with disabilities.
10.2. aXai reserves the right to investigate and take appropriate action against any violations, including removing content, suspending accounts, and reporting to authorities.
11. Data Protection and Privacy
11.1. aXai collects and processes personal information in accordance with our Privacy Policy, which forms part of these Terms.
11.2. We comply with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
11.3. Given the sensitive nature of disability-related information, we implement enhanced protections including:
- (a) Encryption of health and disability-related data;
- (b) Strict access controls;
- (c) Australian data residency;
- (d) Regular security audits.
11.4. By using the Platform, you consent to:
- (a) The collection and processing of data as described in our Privacy Policy;
- (b) The storage of data in Australian data centres;
- (c) The use of data to improve the Platform and AI systems.
12. Accessibility Commitment
12.1. DisabilityX is committed to accessibility and aims to comply with WCAG 2.1 Level AAA standards.
12.2. Accessibility features include but are not limited to:
- (a) aXread text simplification technology;
- (b) Screen reader compatibility;
- (c) Keyboard navigation;
- (d) Adjustable text sizes and contrast;
- (e) Alternative text for images.

13. Third-Party Services
13.1. The Platform may integrate with or contain links to third-party services, including:
- (a) AI providers (Google, Anthropic, OpenAI);
- (b) Cloud infrastructure (Google Cloud Platform);
- (c) Analytics and monitoring services;
- (d) Disability service providers;
- (e) Video platforms (YouTube).
13.2. Your use of third-party services is subject to those services' terms and conditions.
13.3. aXai is not responsible for third-party services and makes no warranties regarding their availability, accuracy, or security.
14. Disclaimers and Limitations of Liability
Disclaimers
14.1. The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.
14.2. aXai does not warrant that:
- (a) The Platform will be uninterrupted, error-free, or secure;
- (b) Results obtained from the Platform will be accurate or reliable;
- (c) AI-Generated Content will be free from errors, bias, or inaccuracies;
- (d) Information about disability services or rights is current or complete;
- (e) The Platform will meet your specific requirements.
14.3. AI-generated outputs and disability-related information should be verified with qualified professionals before reliance, particularly for legal, medical, or NDIS-related matters.
Limitation of Liability
14.4. To the maximum extent permitted by law, aXai's total liability for any claims arising from these Terms or use of the Platform shall not exceed the greater of:
- (a) The amount you paid to aXai in the twelve (12) months preceding the claim; or
- (b) One hundred Australian dollars (AUD $100).
14.5. aXai shall not be liable for:
- (a) Indirect, incidental, special, consequential, or punitive damages;
- (b) Loss of profits, revenue, data, or business opportunities;
- (c) Damages resulting from unauthorised access to your account;
- (d) Damages resulting from third-party services or content;
- (e) Damages resulting from reliance on Platform information without professional verification;
- (f) Any consequences of publishing your story;
- (g) Third-party actions in response to published content;
- (h) Damages resulting from events beyond our reasonable control.
14.6. Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
14.7. We will always act in good faith to protect contributors, but cannot guarantee outcomes.
Australian Consumer Law
14.8. Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) which cannot be excluded, restricted, or modified by agreement.
14.9. If the Australian Consumer Law applies, our liability for breach of a consumer guarantee is limited to (at our option):
- (a) Re-supply of the services; or
- (b) Payment of the cost of having the services re-supplied.
15. Indemnification
15.1. You agree to indemnify, defend, and hold harmless aXai, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- (a) Your use of the Platform;
- (b) Your User Content;
- (c) Your violation of these Terms;
- (d) Your violation of any third party's rights;
- (e) Your violation of any applicable laws.
16. Term and Termination
16.1. These Terms commence when you first access the Platform and continue until terminated.
16.2. You may terminate by ceasing all use of the Platform and closing your account.
16.3. aXai may terminate or suspend your access at any time, with or without cause, with or without notice.
16.4. Upon termination:
- (a) Your licence to use the Platform immediately ceases;
- (b) You must cease all use of the Platform and Platform Content;
- (c) aXai may delete your account and User Content;
- (d) Provisions that by their nature should survive (including Intellectual Property, Confidentiality, Limitation of Liability, and Indemnification) shall survive.
17. Dispute Resolution
17.1. Any dispute arising from these Terms shall be resolved as follows:
- (a) Negotiation: Parties shall first attempt to resolve disputes through good faith negotiation for a period of thirty (30) days;
- (b) Mediation: If negotiation fails, parties shall attempt mediation administered by the Australian Disputes Centre;
- (c) Litigation: If mediation fails, disputes shall be resolved in the courts of Victoria, Australia.
17.2. Nothing in this clause prevents either party from seeking urgent injunctive relief.
17.3. We encourage you to contact us first to resolve any concerns informally.
18. General Provisions
Governing Law
18.1. These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.
Entire Agreement
18.2. These Terms, together with the Privacy Policy, constitute the entire agreement between you and aXai regarding the Platform.
Severability
18.3. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver
18.4. Failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment
18.5. You may not assign or transfer these Terms without aXai's prior written consent. aXai may assign these Terms without restriction.
Force Majeure
18.6. aXai shall not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, government actions, or infrastructure failures.

20. Acknowledgement
By using the Platform, you acknowledge that:
- 20.1. You have read and understood these Terms;
- 20.2. You agree to be bound by these Terms;
- 20.3. You are at least 18 years of age or have parental/guardian consent;
- 20.4. You have the legal capacity to enter into this agreement.
